TERMS OF PURCHASE, WARRANTIES & DISCLOSURES

BTS Mechanical
Authorization & Payment

By signing or approving this invoice, Buyer authorizes BTS Mechanical to perform the services described, including labor, materials, and subcontracted work as necessary. Buyer agrees to be financially responsible for all charges and to remit payment in full upon completion of work, unless otherwise agreed to in writing.

Any balance not paid upon completion may accrue interest at the maximum rate allowed by Texas law. Buyer agrees to pay all reasonable collection costs, including attorney’s fees and court costs, if legal action is required to collect unpaid balances.

Warranties – Labor & Equipment

BTS Mechanical warrants that all labor performed shall be completed in a good and workmanlike manner and shall be free from defects in workmanship under normal use for a period of one (1) year from the date of completion, unless otherwise stated in writing.

All parts and equipment installed by BTS Mechanical are warranted solely in accordance with the manufacturer’s warranty. BTS Mechanical does not provide any independent warranty, express or implied, on manufacturer-supplied parts or equipment beyond those provided by the manufacturer.

Buyer acknowledges that manufacturer warranties may require product registration, routine maintenance, and proof of service to remain valid.

Warranty Service & After-Hours Billing

Warranty service will be performed during normal business hours, defined as Monday through Friday, 8:00 a.m. to 5:00 p.m., excluding holidays.

Any warranty-related service requested outside of normal business hours—including evenings, weekends, holidays, or emergency service—will be billed at the applicable after-hours or emergency labor rates and is payable C.O.D. (cash, check, or approved bank card) at the time of service.

Maintenance Plans (If Applicable)

Maintenance plans provide preventive maintenance only and do not guarantee equipment performance or prevent all breakdowns. Maintenance plans do not include:
> Repairs
> Replacement parts
> Refrigerant
> Electrical components
> Damage caused by normal wear, environmental conditions, improper use, or lack of maintenance

Failure to maintain equipment in accordance with manufacturer recommendations may void applicable warranties.

Extended Labor Warranties (If Purchased)

If Buyer has purchased an extended labor warranty, coverage applies only to labor required to repair or replace covered components during the stated coverage period.

Extended labor warranties do not cover:

> Refrigerant loss or leaks unless specifically stated
> Consumable items (filters, belts, fuses)
> Repairs caused by abuse, neglect, modification, power surges, or acts of nature
> After-hours, emergency, or holiday service (unless explicitly included in writing)

Extended labor warranties are non-transferable unless approved in writing by BTS Mechanical.

Limitations of Liability (Texas-Appropriate)

To the fullest extent permitted by Texas law, BTS Mechanical shall not be liable for incidental, consequential, or special damages, including but not limited to loss of use, loss of comfort, property damage, or personal injury, except where such limitation is prohibited by law.

BTS Mechanical’s total liability under this agreement shall not exceed the amount paid by Buyer for the services performed.

Condensate & Drain Line Disclaimer

Buyer acknowledges that condensate drain lines and related components may clog due to algae, debris, or environmental conditions. BTS Mechanical is not responsible for water damage resulting from clogged or obstructed drain lines unless drain maintenance or repairs were specifically included in the scope of work.

Governing Law & Venue

This agreement shall be governed by the laws of the State of Texas. Venue for any dispute shall lie in the county where the work was performed.
